Terms of Service

These Terms of Service govern access to and use of websites, software, applications, APIs, and services provided by Source IT Solution, including the Source IT Engage platform.

By creating an account, accessing Source IT Engage, purchasing services, or using our website or applications, you agree to these Terms.

If you use Source IT Engage on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

Source IT Solution is a software and IT services business operated by Shri Ranjeetsinh Deelipsinh Ghorpade, registered as a Micro Enterprise under Udyam Registration. Source IT Engage is a software product of Source IT Solution.

1. About Source IT Engage

Source IT Engage is a business software platform designed to help organizations manage customer communications, WhatsApp Business Platform integrations, contacts, CRM records, Inbox conversations, message templates, automation, campaigns, reporting, and related business workflows.

Some capabilities may be introduced progressively, offered in beta, limited by subscription plan, or depend on third-party approval or availability.

2. Eligibility

You must be legally capable of entering into a binding agreement and must use the service for lawful business purposes.

You are responsible for ensuring that all users you authorize to access your workspace comply with these Terms.

3. Account Registration

You agree to provide accurate information when creating your account.

You are responsible for safeguarding passwords, authentication information, administrator accounts, and devices used to access Source IT Engage.

You must notify us promptly if you become aware of unauthorized access or misuse.

4. Workspace and Team Users

Business customers may authorize employees, contractors, agents, or other users to access their workspace.

The account owner or authorized administrator is responsible for user permissions, access rights, and removal of users who should no longer have access.

5. WhatsApp Business Platform

Source IT Engage may integrate with the official WhatsApp Business Platform provided by Meta.

Use of WhatsApp functionality is also subject to applicable Meta Terms, WhatsApp Business Terms, WhatsApp Business Messaging Policy, Commerce Policy where relevant, and other applicable Meta requirements.

Source IT Solution cannot guarantee that Meta will approve a business, phone number, display name, message template, messaging limit, business verification request, or other asset.

Meta may change its APIs, policies, pricing, messaging limits, approval requirements, or functionality independently of Source IT Solution.

6. Meta Authorization

Businesses may connect authorized Meta and WhatsApp Business assets using Meta’s Embedded Signup or other approved authorization process.

You authorize Source IT Engage to access and process the Meta and WhatsApp Business assets you expressly authorize for purposes of providing the requested service.

You remain responsible for maintaining ownership or valid authorization over those business assets.

7. Messaging and Customer Consent

You are responsible for ensuring that recipients have provided consent or that another lawful basis exists for communications where required.

You must honor opt-out requests and must not use Source IT Engage for unsolicited bulk messaging, spam, harassment, deception, unlawful marketing, prohibited products, fraud, or other activity that violates applicable law or platform policies.

8. WhatsApp Templates

Message templates may require review and approval by Meta.

Submission through Source IT Engage does not guarantee approval.

Meta may approve, reject, pause, disable, reclassify, or otherwise modify the status of a template according to its policies.

9. Customer Data

As between Source IT Solution and the business customer, the customer retains ownership of customer-specific business data submitted to Source IT Engage, subject to the rights reasonably necessary for Source IT Solution to host, process, transmit, secure, back up, and otherwise operate the service.

You represent that you have appropriate rights and authorization to provide such information to Source IT Engage.

10. CRM and Business Records

You are responsible for the accuracy and legality of contact records, lead records, notes, pipeline information, tags, customer communications, imported data, and similar business information stored in the platform.

11. Automation

Automation features can perform actions based on rules configured by users.

You are responsible for reviewing workflow configuration, recipients, message templates, timing, conditions, and actions before enabling an automation.

Source IT Solution is not responsible for incorrect actions caused by incorrect customer configuration.

12. AI-Assisted Features

Source IT Engage may offer AI-assisted functions such as draft generation, lead qualification, suggested responses, knowledge-based assistance, workflow suggestions, and reporting assistance.

AI output may be incomplete, inaccurate, inappropriate, or unsuitable for a specific purpose.

Users are responsible for reviewing AI-generated content before relying on it or sending it to customers.

AI functionality should not be treated as professional legal, medical, financial, or other regulated professional advice.

13. Campaigns

Campaign functionality must be used only with recipients who may lawfully receive the communication.

Campaign access may be subject to consent checks, suppression rules, messaging limits, approved templates, subscription restrictions, and platform safeguards.

14. Third-Party Services

Source IT Engage may depend on third-party services such as Meta, WhatsApp, infrastructure providers, cloud services, payment gateways, email providers, AI providers, or other integrations.

We are not responsible for outages, policy changes, restrictions, suspensions, delays, API changes, or actions caused independently by third-party providers.

15. Fees and Billing

Certain services may require payment according to the plan, quotation, order form, invoice, or subscription terms accepted by the customer.

Third-party charges, including Meta/WhatsApp messaging charges or other provider fees where applicable, may be separate from Source IT Solution subscription charges unless expressly stated otherwise.

Applicable taxes may be added as required by law.

16. Suspension

We may suspend or restrict access where reasonably necessary because of non-payment, security risk, suspected fraud, abuse, violation of these Terms, violation of third-party platform policies, legal requirements, or activity likely to harm Source IT Solution, its infrastructure, Meta/WhatsApp accounts, customers, or other users.

17. Intellectual Property

Source IT Solution and its licensors retain ownership of Source IT Engage software, product design, trademarks, documentation, source code, branding, interfaces, and other proprietary materials.

These Terms do not transfer ownership of Source IT Solution intellectual property to the customer.

18. Acceptable Use

You may not attempt unauthorized access, bypass security protections, reverse engineer protected components where prohibited by law, interfere with service availability, distribute malware, misuse APIs, impersonate another business, violate intellectual property rights, send illegal or deceptive messages, harvest contact information unlawfully, or use the platform in violation of applicable laws or third-party terms.

19. Security

We implement reasonable security controls designed to protect the service.

Customers are responsible for their own account security, devices, users, password practices, recipient lists, integrations, and administrator permissions.

Use of Source IT Engage is subject to both this Terms of Service and the applicable Privacy Policy.

21. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free availability.

Maintenance, infrastructure problems, internet failures, third-party outages, security incidents, regulatory requirements, or other circumstances may temporarily affect availability.

22. No Guarantee of Business Results

Source IT Engage is a technology platform.

We do not guarantee specific sales, revenue, conversion rates, response rates, campaign results, message-delivery rates, template approvals, or business outcomes.

23. Termination

You may stop using the service according to your applicable subscription or commercial agreement.

Upon account termination, access may be disabled and applicable customer information may be deleted or retained according to our Privacy Policy, contractual commitments, backup processes, and legal obligations.

24. Disclaimer

To the extent permitted by applicable law, the service is provided on an “as available” basis.

We disclaim warranties that cannot reasonably be provided regarding uninterrupted availability, third-party services, Meta approvals, business performance, or fitness for a particular business purpose.

Nothing in these Terms excludes rights that cannot legally be excluded.

25. Limitation of Liability

To the maximum extent permitted by applicable law, Source IT Solution will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service, third-party platforms, business decisions, lost profits, lost opportunities, or unauthorized use caused by a customer’s failure to protect its account.

Any mandatory liability imposed by applicable law remains unaffected.

26. Changes to the Service

We may improve, modify, add, restrict, or discontinue features as the platform evolves.

Material changes may be communicated through the application, website, email, or updated documentation.

27. Governing Law

These Terms are governed by the applicable laws of India.

Subject to applicable law, disputes relating to these Terms shall be subject to the jurisdiction of courts located in Kolhapur, Maharashtra, India.
